Dearborn Council Considers ‘Preferred Developer’ Extension for Downtown Project

dearborn-crest-logoThe Dearborn City Council could take a vote as early as this week on whether to extend a preferred developer’s agreement with local investor Hakim Fakhoury.

The preferred developer’s agreement is for a major development project on the block north of Michigan between Military and Howard. The agreement, which gives Fakhoury exclusive development rights to the city-owned parking lot, is set to expire at year’s end, according to the Dearborn Times Herald.

Fakhoury, who already owns many abutting properties, tells the Times Herald that the project would include an Emagine! movie theater, retail suites and condominiums or student housing.

We wrote about this proposed project here a few years ago, before the economy took a nosedive.

City Council President Thomas Tafelski tells the Times Herald  he is concerned about how much Fakhoury’s proposal has changed since it was first introduced more than four years ago.

“If the project warrants additional time, then that’s something the council must consider,” Tafelski tells the Times Herald. “But I will also say if the project doesn’t have proper financing, proper direction or the proper modifications, then maybe we should shelve this project and seek new proposals or just let Mr. Fakhoury develop the properties he already owns along Michigan Avenue.”

One of the main sticking points is over parking, the Times Herald reports below.

When the agreement was first signed, city officials indicated they would be willing to build two parking decks to support the project. The tentative plan called for the city to build the structures and then recoup the costs through tax revenues generated by the accompanying developments.

The same model was used by the city in developer Burton-Katzman’s West Village Commons, directly across the street south of Fakhoury’s project, but has since shown that it exposes the city to too much liability. Since the WVC decks were built in 2005, the city has been forced to cover about $2.5 million in revenue shortfalls caused by Burton-Katzman’s failure to complete several portions of the project that would have been contributing to the bond payments.

But Fakhoury said he is unfairly being punished for Burton-Katzman’s misdeeds. Fakhoury said he purchased additional properties to help facilitate the project with the understanding that the city would build the decks. Now he’s stuck holding properties that he said are liabilities — without the help of the larger project to generate economic activity.

“I have done everything they’ve asked of me,” Fakhoury said.“I’ve brought them letters of intent (from prospective tenants), I bought the buildings, and now they don’t want to do what they’re supposed to.”

    there isn’t like a long list of people waiting to develop this parking lot. doubt hakim will ever get this off the ground but giving him an extension seems sensible. besides, he won’t be able to blame others.

    His properties look terrible. Has anyone seen the sidewalk and facade on Michigan Avenue at the old Vic Tanny’s lately? And, take a look in the old pass through/parking area there–it’s become a a place to store junk and garbage. I won’t even talk about the sorry building that used to be Brothers Formal Wear–I bet Lynch’s just loves being next to that mess! I would tend to agree with RJR, but at least make this guy clean up his current properties a bit before he gets the extension. I am not a big Newman fan, but at least his empty properties aren’t such a big mess.

    This is really a hard one to comment on but after all these years are these companies still willing to move to Dearborn? It certainly would be a boom for this city if this could be accomplished. I would love to know what the exact agreement the city signed with Hakim for the 2 parking garages was. Who knows maybe he can sue the city.

    As for his buildings on Michigan Ave. – apparently the city doesn’t think these buildings are such bad shape.

    If he can bring this about becki is right – more power to him – good luck Hakim.

    Has anyone else read the list of forecosed Wayne County properties published in the Detroit Free Press the past two Sundays?

    The list includes several Hakim Fakhoury properties in Dearborn, including the buildings that house Buffalo Wild Wings and Panera Bread in west Dearborn.

    What gives here?

    When is Dearborn going to realize Hakim is nothing more than a con man. Look at all of his properties in Sunday’s paper, and you will see how reliable he is. Tell Hakim to hit the bricks.

    What is the city council thinking? These are the same tired, come-to-nothing ideas that have been around for years. Hakin Fakhoury has yet to develop a viable property. He has completed nothing. And now he’s going to get preferred developer status. This is ridiculous. The only think he has developed are empty store fronts. They were that way long before the economy went south. Doing the same thing over and over and expecting different results is the definition of crazy.

    Also crazy is the city of Dearborn reportedly accepting $8.2 million from the Russian Severstal Steel Company in exchange for “naming rights” to the yet to be built convention center that will be rammed down taxpayers throats.

    Wonder if they will use the old USSR hammer and sickle symbol on the marquee as well.

    Don’t give Fakhoury another chance to make the City look like chumps. He brags how he gets what he wants from the City, but hopefully not this time — wake up council people.

    Question: What do the following 7 Downtown West Dearborn properties have in common?

    Answers: 1 – They are all in foreclosure: 2 – They are all owned by Hakim Fakhoury.

    Preferred developer? Are you kidding?

    As far as the naming rights, I watched the council meeting when they talked about it. They accepted the money but will give it back if the project doesn’t go through.

    If past is prologue; in this case referring to the acrimonious relationship between Russians and indigenous Muslims (think Chechnya, the Caucacus, et al), it will be interesting to see how the Severstal Steel “naming rights” of the yet to be constructed Dearborn convention center pan out.

    To be inclusive, and/or politically correct, they could name it after Shamyl the Chehnyan Muslim warrior who fought off Czarist troops in the 19th century.

    Cloe, nice job pointing those properties out, however, I hope the City Council knows that before making a decision. I’m not sure Hubbard knows, unless O’Reilly tells her and the other members of the council, what to do. Put an end to Hakim, he is simply put a wannabe, and a Trump you aren’t.

    The Severstal resolutions are very interesting. Severstal had an agreement with the city whereby Severstal was to pay significant amount of money to the City. Then, it became less advantegous to the company to pay the money.

    So, the City powers decided to let Severstal make a contribution (tax deductible) to the City coffers. They will use the money for the Convention Center. So, it takes the money that Severstal would have paid into the general fund and transfers money into the Convention Center fund. So, our taxes will go up to support the city budget, or we will face more cuts, and the City powers will be able to understate the cost of the Center.

    The resolution can be found on the city of dearborn website, in the council minutes, under the date of June 1, 2009 Resolution Number 6-391-09.

    Never underestimeate the ability of the City government to shuffle money so we do not know what is going on.

    If this project is about name recognition, why not put O’Reilly’s name on all of the vacant buildings in Dearborn? It would be a lot cheaper and would produce just about the same results.
