No Recommendations, Conclusions in Dearborn City Report on Councilman Thomas Residency Question

An investigation to determine whether Dearborn City Councilman Doug Thomas should be removed from office because of allegations he isn’t a resident turned up questions but no  conclusions in a report issued by the Dearborn city attorney and clerk.

It is now up to the Dearborn City Council to determine whether to hold a special public hearing to get answers to the questions raised. According to the City Charter, just two council members need to sign a petition to begin such a process or a petition signed by at least 200 Dearborn voters would initiate a public hearing. With no city council meeting planned until after the election, it is doubtful Council will do much more.

The five-page document, which makes no recommendations nor draws any conclusions, was issued to the City Council and Mayor two weeks after resident Nancy Siwik asked the Dearborn City Council to investigate whether Mr. Thomas was a Dearborn resident or Florida, where his wife lives and works full-time.  (Click here for the earlier story.)

The investigation did uncover that nearly $12,000 in property taxes for 511 Elmwood in Dearborn, where Thomas lives, have not been paid. The amount owed is $6,855.16 for 2008 and $5,130.70 for 2009. While the Dearborn City Charter does not allow any elected or appointed person to hold office if they are in default to the city, the deed to the home where Thomas lives isn’t in his name. The only name on the deed is his wife, Jane Valentine.

Contacted Thursday evening, Thomas tells us that his wife has “scraped up some money” and the taxes will be paid either Friday or Monday. Asked why the taxes weren’t paid earlier, Thomas said like the rest of America his “retirement stocks have taken a hell of licking.”

As for the investigation into his residency, Thomas called the entire episode “the epitome of political stuff.”

“I have nothing to hide,” he tells us. “The taxes are in her (Jane’s) name. My name is not on the deed. So where are they coming from? This is nothing but a smear. The city doesn’t have a leg to stand on that issue and no leg to stand on my residency. I have been taking political hits for 21 years on council. I have been though a lot in my years. . . ”

“I have contacted my lawyer regarding whether to pursue legal action against Siwik for defamation of character, false information and trying to impact the election, which is proved by her own timing.”

Here is what the report says about his Florida home:

• “Thomas and his wife have a Principal Residence Exemption on a condominium they purchased in 2004 in Bonita Springs, Florida. The Florida homestead exemption was applied for and granted in 2008.” However, the report goes on to say that the State of Florida did recently contact Thomas and his wife informing them that “the Florida homestead exemption will be retroactively removed for tax years 2008 and 2009 because they were also receiving a homestead exemption in Michigan during the same period.” Thomas may now face penalties and interest may be assessed when the corrected Florida tax bill is issued, the report states.

In their report, City Attorney Debra Walling and City Clerk Kathleen Buda, who visited the residence of Thomas, say they did not ask questions that could be perceived to invade the privacy of Thomas or intrude upon City Council’s authority to hold a special public hearing on the matter, if the council so decided. If a hearing were to be held, the city attorney and clerk laid out the following questions in their report that “may be relevant to the determination” of residency. They include a series of questions, which Thomas answered for us, including:

• Why are the 2008 and 2009 taxes on the Dearborn house delinquent, while the taxes on both of his houses in Bonita Springs, Florida are paid? Thomas: the taxes are in my wife’s name and they are being paid.

• Why were there homestead exemptions – one in Michigan and one in Florida? Thomas: my wife was told by council members in Bonita Springs that she should homestead because she was a resident there.

• If he is a Michigan resident, why is his wife registered to vote in Bonita, Springs, Florida? Thomas: She is a resident of Florida and owns a home there.

• Does he have another vehicle or vehicles registered to him in Florida? Thomas: Yes. She has a two seat convertible and I have a Mercury Milan in my name.

• Is his attendance at Council meetings reflective of Michigan or Florida residency? Thomas: It is reflective of my Michigan residency.

• Since the house at 511 Elmwood is for sale, where does Councilman Thomas “intend to return to” in Dearborn if the house is sold? Thomas: I have many options. I can rent or move in with my daughter.

• Does Councilman Thomas have an ownership interest in the property at 511 Elmwood? Jane Valentine is the only name appears on the deed on file in the Department of Assessment. Thomas: No. Jane brought it from her father in 1995.

• Inasmuch as the house at 511 Elmwood is sparsely furnished, were most of his personal belongings and furniture moved to Florida? Thomas: I live in three rooms here. I have food and clothes here. My wife needed some furniture in Florida so some was moved there.

• If Councilman and Mrs. Thomas have established separate permanent residences, according to Florida law, they must be able to demonstrate that they are financially independent of each other. Are they able to demonstrate financial independence of each other? Thomas: Yes, we run out of three separate checkbooks. I take care of expenses here. She takes care of expenses down there.

With the election just weeks away, Thomas remains upbeat about his chances for reelection. He says he only has about six signs up for his candidacy because he says after 21 years on council people should know who he is by now.

Asked what he would do if he isn’t elected, Thomas said he would work to get term limits put on the ballot for Dearborn.

“I do want to stick around to perhaps put term limits in place,” he said. “My parting thing I could do for the city is get term limits in place for this city.”

    This explains why this report “wasn’t quite ready” at this week’s council meeting. There was no point in the administration talking about it if it didn’t provide proof positive Thomas was legally ineligible to hold office and if Thomas could provide answers for the questions raised. It still does its job of raising more doubt it voters’ minds.

    The fact that Thomas spends time in Florida where his wife resides is now well known and it’s up to voters to decide whether they still want him on the council.

    It will be very interesting to see who, if anyone on the council, signs this petition to have a public hearing. I don’t think that any of them want to ‘make waves’ just before the election unless someone in a higher position wants this to happen. As for back taxes, he isn’t the only one on the council to have that problem. Think that this is something that the voters will sort out.

    It baffles me how so many people on this site seem to have this “conspiracy theory” that the big bad administration out to get poor Doug Thomas. The man puts zero effort into his position and doesn’t even live here half the time. His “watchdog” persona is laughable at best, all he did was hitch his wagon to the anti paid parking train and hes been riding that one topic out ever since. Doug is nothing more that a small nuissance to both council and mayor and I hardly think they are the ones who are bending over backwards just to make him look bad.

    Guys, you are missing the plot here. Doug hasn’t paid taxes to the tune of $12,000 over two years. Don’t let the nonsense of him saying his name isn’t on the deed that it doesn’t mean he is responsible. For gosh sake, we elected him to uphold the City Charter. He can play these games of saying he didn’t know this or that or that his name wasn’t on that paper or this one but the reality is he is a crook. He has been stealing our tax dollars in the form of a salary for a council job that he does by phone from his home in Florida. It is a slap in the face to our city and its residents. Doug can call it a smear job or whatever but the reality is he is doing the smearing to our city with his game. Oh, and now, after 22 years on council, he says he would pursue term limits if he isn’t elected? How much more proof do you need to have to know that Doug is about Doug not Dearborn. I do not plan to vote for this thief, cheat and two-talking politician. I am done with him.

    @TJ aka O’Reilly can do no wrong: Where were you when the Abraham thing broke a few months back? Abraham, aka Mr. Land Speculator and big businessman owed 7 times the amount Mr. Thomas’ wife owes and it wasn’t even on his residence, it was on condos on Garrison and his office on Michigan Avenue. Oops, I forgot, the “corporation” owned these so it really wasn’t his obligation after all, was it? NOT! My information is that Thomas’ wife bought the house before she and Thomas were married. So, no, it is not his obligation. I agree with all the other comments–the report was withheld because it proved unuseful–so how much time was wasted on this crap, O, Debbi, and Buda? Oh, and why didn’t the Clerk check his residency info before he was on the ballot? Does our clerk know what she is doing or does she just do what she is told by the mayor? Why do we bother voting for her, anyway?

    Well, Mr. O, I guess when we all hear something about you, especially something negative, we will all believe it and share it with everyone and not wait for an explanation; you will receive the same treatment as you have provided to Mr. Thomas and Mr. Tafelski. Guilty, until proven innocent. Oh, and if I and others are wrong, oh, well, your reputation is shot anyway, so who cares?

    Tafelski has a cushy tax break on his home, admitted to falsifying records at work, and is involved in some ticket fixing. Where is your out cry for him?

    Big O is a BIG bully. Has done NOTHING to clean up City Hall except move people who aren’t performing to another cushy high paying job.

    They ALL need to go. Lets get some new people on this Council including a new Mayor.

    I have not been able to find an answer to my question as to whether they update the website if a homestead status has been changed, or whether they just wait until the next calendar year to add the new information.

Why don’t you have useless Norwood check on these things for you, we know he doesn’t have anything to do, but cover your large ass anyways. If it was up to me, we should clean sweep Big Jack, and his bandits anyway. I understand this will be your last time running for Mayor, next time they should have enough time to make a robe large enough for you to be judge, as thats what you want anyways.

    Happy…forewarned is forearmed. My trips to the Dearborn assessors office to pull records on my own and family homes has been greeted with suspicion and sometimes requirements to fill out a FOIA (Freedom of Information Act) request, which of course generates more $$$ for the city.

    The county always has been much more helpful.

    Okay, I figured out the delinquent tax stuff. But I’m still confused, I don’t see where you find the homestead status? I went to the assessor’s office link, it doesn’t show (at least where I was looking) the names of owners or whether the home is homesteaded or not. Confused.

    I’ve read all the comments here, and all I have to say is that if you don’t like what’s going on, then let’s vote in new members or the ones that can help change Dearborn. We need members that are here in, and live in Dearborn, to see what is happening here. The residents need someone who they can talk to or have easy access to loge their complaints.

    Don’t you feel like some of the council are too complacent as to their winning the election? I see more of the new names going out and presenting themselves then our current council.

    The homestead issue puzzles me because your homestead address is the one that gets you a property tax break. Your non-homestead property (at least in Michigan) is taxed at a MUCH HIGHER rate (ask anyone who owns a cottage).
    So, what if anything would Doug Thomas be gaining by declaring his homestead in Florida???

    Old All Day School Mom – from what I understand, he had declared homestead in BOTH states, one under his wife’s name, one under his. He was getting savings in both states. Also, from my understanding, this is not legal whether he is a city councilperson or not.

Yeah, let me search for some change to park in this empty lot – NOT! I think he had the right idea about Dearborn. Dearborn, you’re a has-been still trying to get it right but are learning Detroit ways at the same time.

    I don’t understand why the State doesn’t get involved in this Doug Thomas deal. They don’t seem to have a problem going after people who are not politicians. I bought a home under my name for one of my children and they immediately fined me for not claiming it as a non-homestead and if I didn’t correct it, there would be other consequences. I’d like to know how these “politicians” get away with it, but then again don’t they get away with alot of things? We need new and young blood on the council. Thank you all of you that have served “several years” but it is time now to step down and let young ideas reign. From what I can see and hear some of the present council members just sit there never come up with any good ideas, they simply agree on just about everything because they don’t even understand what there voting on. These are good people, but we need to vote in some new ideas for the future of the City
